TERMS OF USE
Last updated: 2026-08-07
These Terms govern your access to and use of the ENDURE Services. By using the Services, you agree to these Terms.
1. Provider / Contact
Provider: Christoph Martin (ENDURE)
Address: Fischerweg 8, 7503 Großpetersdorf, Austria
Email: info@endure-cycling.com
2. The Services
ENDURE provides indoor cycling training features, including workout creation/import, workout execution (including trainer control where supported), and performance analytics/insights.
Features may change over time and may vary by platform, device, trainer, sensors, and region.
3. Eligibility & Account
You must be at least 16 years old (or the age of digital consent in your country). You are responsible for your account and for safeguarding your credentials.
4. Beta / Early Access
The Services may be offered as a Public Beta. Beta features may be unstable, inaccurate, incomplete, or unavailable. Beta is provided “as is” and may change or be discontinued at any time.
Accounts created before ENDURE introduced paid subscriptions keep full access to all Premium features at no cost, for as long as the account exists. This applies automatically; nothing needs to be claimed. It does not extend to accounts created afterwards.
5. Health & Safety — Not medical advice
ENDURE is provided for fitness and informational purposes and does not constitute medical advice. Training involves risks. You are solely responsible for:
- choosing appropriate workouts and intensity,
- using your trainer/sensors safely,
- stopping immediately if you feel unwell.
Trainer control (ERG/resistance) may change load. Ensure safe setup and supervision where appropriate.
6. Device connectivity & accuracy
Trainer and sensor connectivity depends on third-party hardware, firmware, OS behavior, and wireless conditions. We do not guarantee uninterrupted connectivity, correct trainer control, or perfect measurement accuracy.
Metrics such as FTP/VO₂max may be estimates and may be inaccurate.
7. Imports and third-party services
You may import workout/activity files from third parties. You represent you have the rights to use and import that content. We are not responsible for third-party availability, formatting changes, or data quality.
8. Acceptable use
You agree not to:
- misuse the Services, interfere with operation, attempt unauthorized access,
- reverse engineer or circumvent security (except where permitted by law),
- upload malicious code or infringe third-party rights,
- use the Services unlawfully.
We may suspend or terminate accounts for violations.
9. Subscriptions and payment
Free and paid use. Parts of the Services are free to use; others require an active ENDURE Premium subscription or a running free trial. Which features are included in each is shown in the app and on endure-cycling.com and may change over time in line with section 2.
Free trial. New subscriptions may include a free trial period. The exact duration and price are always shown on the purchase screen in the app before you confirm. Unless you cancel before the trial ends, the subscription starts automatically and the first payment is taken at the end of the trial. Each account and store account is eligible for a trial once.
Term and renewal. Subscriptions renew automatically at the end of each billing period (monthly or annual, depending on the plan you choose) until cancelled. Cancellation takes effect at the end of the current period; access continues until then.
Billing and cancellation. Subscriptions are sold and billed through the Apple App Store or Google Play. Payment is charged to your store account, and you manage or cancel the subscription in your store account settings — not in the ENDURE app. The respective store’s terms apply to the payment relationship, including its refund policy.
Price changes. We may change prices for future billing periods. Existing subscribers are notified in advance and, where required by applicable law or platform rules, are asked to consent; otherwise you may cancel before the change takes effect.
Availability. Premium features depend on the Services being available and may change over time, as described in section 2. Where a Premium feature is discontinued without replacement and this substantially reduces the value of your subscription, you may cancel and, where required by law, receive an appropriate remedy.
10. Right of withdrawal (EU/EEA consumers)
Because subscriptions are sold through the Apple App Store and Google Play, those platforms are your contractual counterpart for the purchase. Statutory withdrawal rights and refunds are therefore handled by the respective store under its own policy:
- Apple: request a refund via reportaproblem.apple.com.
- Google Play: request a refund via your Google Play order history or Google Play support.
If you believe a refund was handled incorrectly, contact us at info@endure-cycling.com and we will help where we can.
11. Intellectual property
The Services and all related IP (software, design, trademarks, content) are owned by the Provider or licensors. You receive a limited, non-exclusive, non-transferable license to use the Services for personal use, in accordance with these Terms.
12. Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available”. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
13. Limitation of liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, special, consequential damages, or loss of profits, data, or goodwill.
- Our total liability for any claim relating to the Services is limited to the amount you paid to us for the Services in the last 12 months (or €0 if you paid nothing).
Nothing in these Terms excludes liability where it cannot be excluded under mandatory law.
14. Termination
You may stop using the Services at any time. We may suspend or terminate access for violations of these Terms or for security/legal reasons.
15. Governing law and jurisdiction
These Terms are governed by the laws of Austria, excluding conflict-of-law rules. If you are a consumer in the EEA, mandatory consumer protections in your country of residence may also apply.
